Georgia Supreme Court Ruling Extends Open Records Requirements to Private Sector Partners

In a pivotal ruling, the Georgia Supreme Court has broadened the scope of the Georgia Open Records Act (the Act) to encompass private businesses and contractors collaborating with state and local government entities.

The decision in Milliron v. Antonakakis establishes that public records maintained by non-government entities are subject to the same transparency standards as those held by government agencies. As a result, industries such as construction, IT, healthcare, and consulting must carefully comply with the Act’s requirements to mitigate potential liability.
